The legal basis for the above processing of your Personal Data is that the processing is necessary to fulfil our contract obligations under the Service agreement, the DPA, and fulfil the user account agreement with you, article 6.1 b) GDPR. NaCon may process your Personal Data for the purposes of establishing, exercising, and defending legal claims e.g. in the unlikely event of a dispute.

5.0 Length of time that we keep your Personal data for
NaCon will retain Personal Data for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by local law to which NaCon is subject.
We are using the following criteria to establish our retention period:
5.1 as long as we have an ongoing relationship with you (either as an individual or in your capacity as employed by one of our corporate clients, suppliers, or co-operations partners);
5.2 as required by legal obligations to which PayPugs is subject (such as tax and accounting obligations, Financial and other regulations, etc); and
5.3 as advisable in light of our legal position (such as applicable statutes of limitations).

6.1 Group of companies
NaCon Services may disclose Personal data processed to other companies within the NaCon Services group and/or its partners in accordance with Intra Group Data Transfer Agreement.
6.2 Data processors acting on behalf of NaCon Services
Moreover, NaCon may disclose Personal Data to external parties, such as vendors and service providers processing Personal Data on behalf of and under the instructions of NaCon.
6.3 Appropriate Safeguards to countries outside the EU/EEA-area
6.3.1. Where NaCon transfers Personal Data outside the EU/EEA, NaCon services will ensure that Standard Contractual Clauses have been entered into between the transferring NaCon entity and the receiving external party.
6.3.2. Alternatively, other safeguards will be put in place prior to such transfers. You are under Applicable Data Privacy Law upon request entitled to receive a copy of any documentation demonstrating that appropriate safeguards have been taken to protect your Personal data during a transfer outside the EU/EEA.

We will ensure that the access to your data is accurately secured by applying appropriate safeguards, depending on the circumstances considering the state of the art, the costs of implementation, and the nature, scope, context, and purposes of processing as well as the risk.
